Residents of Bungoma town were treated to a rare drama at the Bungoma Lawcourts when a murder suspect accompanied by his 10 guards in black suits were arrested and ordered to lie on the ground by the dreaded Flying Squad as they searched for guns.
The suspect Henry Waswa popularly known as Sonko is chaed of killing a university student in Kimilili last year in his Kimilili bar and had been released on bond was appearing for the hearing of his case accompanied by 10 guards.
The suspect allegedly killed a Mombasa University College student Mitch Kibiti who is also the son of Bungoma county public administration chief officer David Kibiti.
Police sources told Weekly Citizen that investigations had revealed that Waswa had irregularly acquired the licence of the fire arm and he had failed to account for some bullets.
Meanwhile a lawyer representing the Director of Public Prosecutions Keriako Tobiko got himself in hot soup when he exchanged bitter words with police who accused him of taking a bribe from the murder suspect.
Trouble started when police rearrested Waswa who had just finished a hearing of case of murder.
Lawyer John Oyimbo was accused of taking off with the file from the courts prosecutions office when the police were about to charge Waswa with a new charge of failing to surrender the firearm certificate that had been cancelled and also failing to account for some ammunitions as required by the fire arms Act.
Oyimbo who had earlier been dropped from representing the DPP in the murder case after the family of slain Mitch Kibiti complained of him being ineffective and aiding the suspect.
Police however took offense when Oyimbo tried to defend Waswa whom he did not want to be changed causing a bitter exchange between him and the police.
A policeman was heard accusing Oyimbo of receiving bribes from Waswa warning that they were going to produce evidence that he took bribes.
“What is your interest as the represantive of the state yet you want to fight others not to charge this criminal, we will expose you,” said an officer who had already drawn his gun.
Waswa was later charged and released on Sh100,000bond
Earlier an application by Waswa to have his passport released on grounds that he wanted to fly to the United Kingdom for treatment was turned down by Judge Abida Ali Aroni.
